Avoiding and Managing Construction Disputes Across the Project Lifecycle

There are many different reasons why disputes may arise on projects. Ideally, projects can avoid disputes altogether. However, it is possible that your project will experience a dispute of some form. Disputes can add to the challenges faced in project management and create not only distractions, but larger issues for projects if they are not managed. Disputes, and their impacts, can be mitigated in a number of ways. This includes considerations made at early stages of projects, contract awareness, contract management, identification and management of possible risk events at different stages of execution, management of change, and relationships.
This presentation will start with an overview of the common factors that cause project overruns in cost and/or time and resultant construction claims/disputes, as well as project warning signs. The presentation will discuss the project lifecycle, including considerations to support dispute avoidance and effective dispute management at the different stages of the project lifecycle. Contracting strategies, contract administration, and the importance of project controls, documentation and communication, will be explored, as well as the different ways disputes may be resolved between project parties. Practical examples will be provided throughout the presentation.
Dina is a consultant for Revay’s Vancouver office with over 15 years of professional experience in construction management, forensic delay analysis and dispute resolution. Dina holds a construction engineering degree from the American University in Cairo and a Master of Law in Construction Law and Arbitration from Robert Gordon University. She holds a Member status with the Chartered Institute of Arbitrators (CIArb), and is a Project Management Professional (PMP).
Suzanne is a professional engineer with more than 20 years of technical, project management, and corporate leadership experience in the engineering and construction industries. She has provided technical and project leadership for numerous projects within the energy sector with complex engineering, supply chain, construction, project controls, risk management and change management requirements. Suzanne holds and electrical engineering degree from the University of Alberta and a Master of Business Administration from Queen’s University. She is registered as a professional engineer (P.Eng.) in Alberta.
